Collaborative Domestic Law

Collaborative law is a legal process, primarily used in family law matters incident to separation and divorce, in which the parties agree they will not go to court to resolve their dispute. Each party is represented by their own attorney who is their advocate and advisor. All parties to the collaborative law process, including the attorneys, commit to working together cooperatively, respectfully, and openly to arrive at a settlement agreement that best meets the needs of the parties and their children, as the case may be. In the collaborative process, the parties retain control over the outcome rather than relinquishing decision-making to a court. The collaborative attorney cannot represent his or her client in subsequent litigation if the collaborative process breaks down.

Collaborative professionals, including child therapists, divorce coaches, and financial experts may be involved, as needed. The intent is a more peaceful and dignified process that supports closure and works to avoid further hurt and dysfunction between the parties often associated with traditional oppositional divorce and other domestic matters.
